1. The Contract Between Us

1.1 – A deposit is required for each keepsake to secure your order, deposit is non-refundable.

1.2 – Full payment for the keepsake that you order must be paid in full before I start to make your keepsake.

2. Delivery of Goods to You

2.1 – I will deliver the goods ordered by you to the address that you give us for delivery at the time you make your order. It is your responsibility to ensure you input this information correctly and that you check for typographical errors.

2.2 – Delivery will be made as soon as possible although any date or period for delivery should be as indicative only. Estimated delivery times will be detailed on our website.

2.3 – I reserve the right to change turnaround times without notice at any given time.

2.4 – You will become the owner of the goods that you have ordered when they have been delivered. Once goods have been delivered to you they will be held at your own risk and I will not be liable for their loss or destruction. Refunds cannot be given if your gift is not passed onto you following delivery at the delivery address that you have provided.

2.5 – I will not be responsible for delays or damages in the delivery caused by any third party.

3. Price

3.1 – The prices payable for goods that you order are as set out in our website and all prices are quoted in pounds sterling. You can pay by PayPal or bank transfer

3.2 – You will be required to pay extra for delivery unless otherwise stated. It might not be possible for us to deliver to some locations. You will be provided with the total price of the transaction including postage and packing before you complete your purchase. There are no hidden extra costs. All our delivery charges are set out on our website.

3.3 – No items will be dispatched until full payment has been made.

4. Cancellation By Us

4.1 – I reserve the right to cancel your order if:

4.1.1 – I have insufficient stock to deliver the goods that you have ordered

4.1.2 – I do not deliver to your area; or

4.1.3 – one or more of the goods that you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information

4.1.4 – I don’t have the ability to make your item anymore

4.2 – If I do cancel your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your original payment method as soon as possible but in any event within 30 days of your order. I will not be obliged to offer any additional compensation.

5. Liability

5.1 – For keepsake items where you have to send in your items to us, we will not be liable for any damaged or lost items. It is solely your responsibility to ensure all items are received by us undamaged. We advise using a recorded delivery service.

5.2 – I will design your keepsake on how items of clothing are used – if you feel you would like you input about where certain pieces of clothing are used you must inform me either at the time of ordering by email or include a note  with your clothing. I will not be liable for any damages or loss incurred as a result of my decisions on how we have designed your keepsake.

6. Right For You To Cancel or Return Your order or alter a finished keepsake

6.1 – You may cancel your order with us for the goods that you order at any time but you will loose your deposit.

6.2 – You cannot cancel your order once production has commenced due to the bespoke nature of the item. Each keepsake is individual, so we cannot guarantee that your keepsake will look identical to the photographs on our website.

6.3 – To cancel or return your order you must notify us in writing. This should be submitted in written form by e-mail to the following address: Bonnybears@gmail.com

6.4 Where there is no actual fault with the item but you are unhappy with the appearance we may agree to try and alter it for a fee and you will need to cover the postage back to us.  We cannot refund or exchange used or customer damaged items.

6.5 When returning items please get proof of postage and where possible use recorded delivery.  For items that are faulty or incorrect we will refund the postage.

7. Events Beyond our Control

7.1 – I shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

8. Disclaimer

8.1 – I do my very best to ensure that all of the information on my website is correct. As many of my keepsakes are handmade, all measurements are approximate and all finishes are to the very best of my ability. I will not replace items where they do not exactly match the product example photograph on the website.

9. Web Site Usage and Conditions

9.1 – All contents in this website (including all images, photos, descriptions, and any other material are owned by Bonny Bears. It is protected by copyright, which along with all other intellectual property rights belong to Bonny Bears.

10. Social Media Giveaway: Official Terms and Conditions

These Terms and Conditions apply to the Bonny Bears Christmas Memory Bear Giveaway" run on Facebook and Instagram.

1. The Promoter

The promoter is Bonny Bears, Wales, UK.

2. Eligibility

• Age: Entrants must be 18 years of age or older at the time of entry.

• Location: The contest is open to residents The United Kingdom only, due to shipping and logistics.

• Employees: Employees of the Promoter and their immediate families are not eligible to enter.

• Account: Entrants must have a genuine, public, or non-locked social media account to be considered valid.

3. Contest Period

The contest begins on 10am 18th November 2025 and ends on 6pm PM GMT on December 24th, 2025]. Entries received outside this period will not be considered.

4. How to Enter

To enter the contest, entrants must follow the steps outlined in the official giveaway post:

• Follow the Promoter’s Facebook/Instagram page.

• Like the official giveaway post.

• Comment on the official giveaway post stating whose clothes they would use for the Memory Bear and why.

IMPORTANT: No purchase is necessary to enter or win. A purchase will not increase the chance of winning. Any entry requirements not listed above (e.g., sharing the post, tagging friends) are optional and will not confer an additional advantage.

5. The Prize

The prize is one (1) custom-made Memory Bear (the "Prize"), valued at approximately £75. 

• The Prize includes the creation and standard UK shipping of the Memory Bear.

• The Prize is non-transferable, non-exchangeable, and no cash alternative will be offered.

• The winner is responsible for safely sending the necessary clothing items to the Promoter within [X] days of being notified as the winner.

6. Winner Selection and Notification

• Selection Method: The winner will be selected based on [a random draw from all entries. 

• Announcement: The winner will be announced on December 24, 2025, via a new post and/or Story update on the Promoter's social media pages.

• Notification: The winner will be contacted via Direct Message (DM) on the platform used for entry within 24 hours of the draw.

• Claiming Prize: If the winner cannot be contacted or fails to claim the Prize within 48 hours of notification, the Promoter reserves the right to withdraw the Prize from the winner and select a replacement winner using the same selection method.

7. Data Protection and Publicity

By entering, entrants grant the Promoter the right to use their social media handle and entry comment for the purpose of announcing the winner and related publicity, without further compensation. The Promoter will not store or use personal data for marketing purposes unless the entrant has opted-in separately.

8. Limitation of Liability

The Promoter is not responsible for any issues arising from lost, delayed, or misdirected entries, or any technical failures. The Promoter reserves the right to cancel, suspend, or amend the promotion and these terms and conditions without prior notice if circumstances make this unavoidable.

9. Social Media Disclaimer

This promotion is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram (Meta). By participating, entrants agree to a complete release of Facebook and Instagram from any claims.
